1. Introduction These Terms and Conditions govern the supply of waste management services by Motiva Group Waste to you (the “Customer”). By booking a service, hiring a skip, or signing a commercial contract with us, you agree to be bound by these terms.
2. Services Provided We utilize reasonable care and skill to provide:
Residential Waste Collection
Commercial Waste Management
Skip Hire
Recycling Services
3. Customer Obligations
Access: You must ensure that our vehicles have safe and unobstructed access to the waste containers or skip location on the scheduled collection day.
Prohibited Waste: You must not place hazardous materials in our bins or skips. This includes, but is not limited to: asbestos, batteries, fluorescent tubes, paints, solvents, medical waste, and tires.
Overloading: Bins and skips must not be filled beyond their water-level capacity. We reserve the right to refuse collection of overloaded containers or charge an extra fee for the removal of excess waste.
4. Skip Hire Specific Terms
Permits: If a skip is to be placed on a public highway, a council permit is required. We can arrange this on your behalf, but the cost is payable by the Customer.
Damage: While we take every care, we do not accept liability for damage to driveways or underground services (pipes, cables) caused by the weight of the skip or delivery vehicle, provided we have acted under your instructions.
Rental Period: Standard skip hire duration is up to 14 days unless agreed otherwise.
5. Payments and Billing
Residential: Payment is due upon booking or as per the subscription schedule agreed.
Commercial: Invoices are issued monthly and must be paid within 30 days of the invoice date.
Late Payments: We reserve the right to suspend services if payment is not received by the due date.
6. Cancellations and Refunds
Cancellations: You may cancel a service up to 24 hours before the scheduled collection time for a full refund. Cancellations made less than 24 hours in advance may incur a call-out fee.
Missed Collections: If we miss a collection due to our error, we will arrange a catch-up collection within 24-48 hours at no extra cost. If the collection is missed because access was blocked or the bin was not out, a return fee may apply.
7. Limitation of Liability Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence. Subject to this, Motiva Group Waste shall not be liable to the Customer for any indirect or consequential loss, including loss of profit or business interruption.
8. Governing Law These terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
